Each Florida liquor license grants the holder the right to sell in a specific Florida county, such as Volusia. Liquor licenses are not transferable between counties. They are, however, transferable between owners, which means you can legally buy or sell any Volusia County alcohol license.

How to Buy a Volusia County Liquor License

There are two ways to acquire a Volusia County alcohol license. The first option is to secure an alcohol permit from Florida’s Division of Alcoholic Beverages & Tobacco (AB&T), and the second option is to buy a liquor license in Volusia County on the open market from a liquor license broker, like Liquor License Auctioneers.

As a result of the limited number of quota liquor licenses in Volusia County, usually, the only option for buyers is to obtain an alcohol license from the secondary market. However, there may be a waiting period due to the lack of Volusia County alcohol permits available at any given time, and the buyer may have to wait for a seller to sell a liquor license to them in Volusia County, FL.

At Liquor License Auctioneers, we pride ourselves on being the only online auction platform for liquor licenses in Volusia County, Florida. Since 2012, we’ve developed many exceptional relationships with both lawyers and business entrepreneurs in the business sector. With these connections, we have the ability to offer select alcohol licenses in Volusia County only on our bidding platform. To complete the transfer of a Volusia County alcohol license between owners, both parties will need to follow these eight steps.

  1. Set a Price for the Liquor License: The party selling the Volusia County liquor license will set an asking price, including the auction fee, and then will offer this set price to the buyer.
  2. Create a Purchase Agreement: If the buyer agrees to pay the seller’s asking price, then both the seller and buyer will complete and sign a written Purchase Agreement.
  3. Pay 10% of the Cost of the Liquor License Upfront: A total of 10% of the cost of the Volusia County liquor license must be placed into an Attorney Trust Account by the buyer. This will remove the Volusia County alcohol permit from the auction. At this time, the closing date for the sale of the liquor license will be chosen.
  4. Prepare the Bill of Sale & All Closing Documents: The Volusia County alcohol permit seller should have their attorney help with the completion of the following documents: the Bill of Sale, the Alcohol License Transfer Affidavit, the Closing Documents, and any additional forms for the AB&T Application. Then, the buyer will have an escrow agent or attorney put all these documents in escrow until the closing date.
  5. Seller Pays Transfer Fees: If fees have been incurred, they will be deducted from the seller’s earnings on the sale of the Volusia County liquor license.
  6. Buyer pays the AB&T Annual License Fee: The buyer, their escrow agent, or attorney will pay the annual license fee, which is prorated, at the closing of the sale of the Volusia County liquor license. A Bank Check, Cashier’s Check, an Attorney’s Trust Account Check, or a Bank Wire can be made out to the seller’s attorney. The closing statement must also be given to them at this time.
  7. Closing the Bill of Sale: The buyer will receive copies of all related documents, including the Closing Statement, the Affidavit of Transferor, and the original Bill of Sale for the Volusia County alcohol license from the seller’s escrow agent or attorney.
  8. Submit Transfer of Liquor License Application Documents to AB&T: With the help of the buyer’s attorney or escrow agent, the buyer can hold the Volusia County liquor license in escrow with the Division of Alcoholic Beverages & Tobacco (AB&T). However, if the business is ready to open with approval from the AB&T, the Department of Alcoholic Beverages & Tobacco (AB&T) will send a temporary Volusia County alcohol license to the buyer.

Our expert liquor license brokers can assist you in completing these nine steps to obtain a Volusia County liquor license.

  1. Secure the location: The property where you will sell or serve alcohol must be either leased, rented, or purchased.
  2. Select your liquor license: With your type of business in mind, you’ll determine which Volusia County liquor license your business requires. Then, you’ll either purchase it from the Department of Alcoholic Beverages & Tobacco (AB&T) or through the open market using a liquor license broker, like Liquor License Auctioneers.
  3. Survey the location: You must have an initial inspection of your brick-and-mortar location done by either a hired surveyor or our alcohol permit brokers.
  4. Complete your AB&T Application: When filling out the AB&T Application, all related forms and documents must be properly completed, including registering with the Florida Division of Corporations, getting zoning approval, as well as health and human resources approval, Department Revenue approval, fingerprints, filing all related party personal information, providing a right of occupancy, service agreements, management contracts, originating agency identification number, paying a fee, and including a blueprint of the place of business where you’ll be selling liquor.
  5. Submit your AB&T Application: The completed Department of Business & Professional Regulation (DBPR) AB&T Application and all additional documents must be sent to the division district office in Volusia County, Florida, for approval.
  6. Post the temporary initial license: If you’d like a temporary alcohol permit for Volusia County, you can pay a fee, and the Division of Alcoholic Beverages & Tobacco (AB&T) will send you a temporary liquor license, which you are instructed to display at your business.
  7. AB&T Application Review: The AB&T Application and all additional forms will be reviewed at this time by the Department of Business & Professional Regulation (DBPR) Alcoholic Beverages & Tobacco (AB&T) and are added to their data system.
  8. Submit to investigation: A final investigation will be conducted by the AB&T to be sure your business establishment is up to code, and you’ve completed all necessary steps required to obtain a Volusia County alcohol license.
  9. Receive the liquor license: If the DBPR AB&T determines that you’ve completed the brick-and-mortar inspection and approves your Volusia County AB&T Application, they will send you a bill for the total cost of the alcohol permit. Once they receive your payment, the AB&T will mail you the Volusia County liquor license, and you must post it at your business.

Following the previous nine steps will meet the criteria set by the Department of Business & Professional Regulation (DBPR) Alcoholic Beverages & Tobacco (AB&T) for purchasing a Volusia County liquor license. To accelerate the process of receiving a Volusia County alcohol permit, check with your local municipal government to see if they require additional stipulations. If you are prepared to meet the municipality’s regulations, you’ll have your DeLand liquor license in no time.
