Pixel Tags

Liquor License Auctioneers does not use pixel tags (also known as “clear gifs”, “beacon gifs”, etc.). Third-party service providers, or websites you have used to get to our website, or where you may go after you leave our website, use or may use pixel tags. Pixel tags are not visible to the user of the website and consist of a few lines of computer coding delivered with the Web page. Pixel tags are  used to collect personally identifiable information about you. When a third-party website uses pixel tags they are used to:

  • Track customer response to advertisements and website content;
  • Determine your ability to receive HTML-based email messages. Email service providers include a pixel tag, which they refer to as a “coded sensor” in all of the HTML-based messages sent. You will know you are in secure mode when the padlock or key icon in the lower right-hand or left-hand corner of the computer screen appears in the locked position. After information reaches Liquor License Auctioneers, it is stored on a dedicated secure server that resides behind firewalls designed to block unauthorized access from outside of Liquor License Auctioneers. For example, if you would like to list an alcoholic beverage license, participate in an auction, or open an escrow for the purchase, sale and transfer of an alcoholic beverage license, we may or will ask you for information such as name, address, telephone number, email address, alcoholic beverage license number, and other personal information to process your particular transaction. If you are a buyer, we will never ask you for your credit card number. However, if you elect to use Chase Bank Secure Money Transfer as your method of payment, Chase Bank Secure Money Transfer will ask you for your credit card number or bank or checking account number or for other personally identifiable information from you, subject to Chase Bank Secure Money Transfer’s applicable privacy policies. If you intend to use Chase Bank Secure Money Transfer, you should review their privacy policies before providing any credit card, bank or checking account, or other personally identifiable information to it and/or to them.

If you are a buyer or a seller of an alcoholic beverage license, our preferred independent escrow company or another selected escrow company, may request you to provide it with personally identifiable information. Prior to providing any such information to our preferred independent escrow company or to another selected escrow company, you should review their privacy policy for using and protecting your personally identifiable information. We will use your email address to send a correspondence and information and, if necessary, might use the other information to contact you for help in processing the transaction in which you are or want to become involved in. We may or will also use your contact information to:

  1. send you transaction related details and provide other information or documentation concerning the transaction; or
  2. notify you about other transaction related matters.

Occasionally, you may be requested to provide personally identifiable information about others to us (for example, the name, address and contact details of your business partners or associates as such information relates to any pending or anticipated alcoholic beverage license listing, auction or escrow transaction). In such cases, we rely on you to obtain that other person’s consent for disclosing their information to us and inform that other person(s) about us, how we will use the information and our contact details for any queries. We will request that you provide us with written consent(s) from all other persons from whom you will be providing us with personally identifiable information. If you are acting as any person’s personal representative, guardian, conservator, attorney in fact under a power of attorney, trustee or other legal or court appointed representative, we will ask you for written confirmation of your authority.

RESERVATION OF RIGHT NOT TO PROCEED AND LIABILITY WAIVER

In the event you fail or refuse to provide us with a requested written consent or with written confirmation of your authority, as applicable, we reserve the right to refuse to commence or proceed with any auction or sale and transfer of an alcoholic beverage license until such consent or written confirmation is provided.

Liquor License Auctioneers assumes no liability whatsoever, or at all, to you or any other person or entity in the event we elect to exercise our reserved rights mentioned immediately above in response to a failure to provide us with any requested consent or authority confirmation. Our non-assumption of liability means we will not be liable or responsible to you or to any other person or entity for monetary damages or losses, of any kind, type or amount, whatsoever, whether or not resulting from known or unknown facts and circumstances concerning the proposed alcoholic beverage license auction, sale and transfer. This means we will not be liable to you or any other person or entity for general, special or punitive damages alleged to have resulted from our exercise of the above reserved rights.

In the event you fail to provide us with a requested written consent or confirmation of your authority, you shall be deemed to have released us from any and all further responsibility and liability, monetary and otherwise, to proceed with the specified alcoholic beverage license auction, transfer and sale transaction, and you shall specifically be deemed to have released all of your rights arising under California Civil Code § 1542, or under the similar laws of any other applicable state, which states:

“Certain Claims” Not Affected by General Release. A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if know by him or her must have materially affected his or her settlement with the debtor.”

Disclosure of Information to Third Parties 

In addition to the alcoholic beverage license listing and auction services and required information sharing described in our privacy statement, Liquor License Auctioneers does use the services of third party processors, such as escrow services, and others that process alcoholic beverage license listings, auctions, sales and transfers, including the payment of applicable fees and costs associated with such auctions, sales and transfers, persons authorized by you, and Liquor License Auctioneers as well as such entities that provide these services for Liquor License Auctioneers and authorized third parties.These parties are contractually prohibited from using personally identifiable information for any purpose other than for the purpose you and/or Liquor License Auctioneers specifies. We do provide non-personally identifiable information to certain service providers for their use on an aggregated basis for the purpose of performing their contractual obligations to us.

This would include, but may not be limited to, escrow service providers, or Chase Bank Secured Money Transfer, as applicable.

Except as described in this paragraph and the other sections of the Liquor License Auctioneers privacy statement, we do not permit the sale or transfer of personally identifiable information to entities outside of Liquor License Auctioneers and its and/or your third party service providers, including but not limited to escrow services and Chase Bank Secured Money Transfer, as applicable, for any non-Liquor License Auctioneers use, without your approval.
