How to Apply for a Liquor License in Passaic County, New Jersey: 

 

  1. Enter into a Contract of Sale: First, the buyer (transferee) and the seller (transferor) will enter into a contract of sale.
  2. Complete the 12 Page ABC Application: Then, you must complete all 12 of the pages in TRIPLICATE of the ABC Application for a Passaic County alcohol license. They must have all original signatures.
  3. Pay the Annual License Renewal Fee: As part of the NJ ABC Application process for a Passaic County liquor license, you must pay a 10% Annual License Renewal Fee for Person-to-Person alcohol permit transfers and Place-to-Place Passaic County alcohol permit transfers. For Person-to-Person and Place-to-Place transfers, a 20% Annual License Renewal Fee will be incurred.
  4. Write a $200 Check or Money Order for ABC: Send a check or money order worth $200 to the State of NJ, Division of Alcoholic Beverage Control for them to process your ABC Application for a Passaic County liquor license.
  5. Consent to Transfer: The current Passaic County liquor license owner will need to sign and notarize the Consent to Transfer or consent of sale of the Passaic County alcohol license.
  6. Disclosure Statement of Applicant: As part of the ABC Application for the Passaic County liquor license, you’ll need to submit the Disclosure Statement of Applicant (source funding).
  7. Submit Federal & State Fingerprint Reports: The federal and state fingerprint reports obtained by the police will need to be submitted to the NJ Division of ABC.
  8. Additional Investigative Report: The police should conduct an additional investigative report. They will then give you a copy of the written report, and this will need to be submitted along with the ABC Application for the Passaic County alcohol license.
  9. Send a Detailed Sketch of the Business Premises: When submitting the required detailed sketch of your business establishment and proposed licensing area, you must also include a photo of the outside of your business premises. 
  10. Affidavit of Publication: A Notice of Intent to Transfer will be published two times within a time frame of three weeks. There will be a week in between when it is not published to allow for the public to voice any objections that they may have with the alcohol license transfer. Objections will be sent over to the local issuing authority in writing and will need to be addressed.
  11. Submit a Certificate of Sales Tax Authority: Send in the Certificate of Sales Tax Authority, and then the buyer will receive the Alcoholic Beverage Retail Licensee Clearance Certificate for Transfer.   12. Application for Bulk Sale Permit: The Passaic County liquor license buyer can choose to purchase any leftover liquor inventory from the current owner. If the buyer decides to buy any of the alcoholic beverages, they must write out a check worth $75 to the NJ Div. of Alcoholic Beverage Control. On the other hand, if the buyer doesn’t want to purchase the existing liquor, then they do not need to send a check, but they will still need to fill out the Application for Bulk Sale Permit and send it in with the NJ ABC Application.
  13. Provide a Letter from the Buyer’s Attorney: The buyer’s attorney will write a letter addressing the closing date of the sale and transfer of the Passaic County alcohol permit. This letter will be sent to the local issuing authority.
  14. Resolution of Transfer: At this time, the Resolution of Transfer will be passed by the local issuing authority in Passaic County, and this is not contingent on another action.

 

The License will be Amended to Reflect New Ownership: The final step in the ABC Application process for a Passaic County alcohol license involves showing the new ownership and generation change on the liquor license as well as on the ABC Application. If any fees are outstanding, the buyer should write a check made payable to the Director, Division of Alcoholic Beverage Control.
