On May 30, 1978, the California State Supreme Court invalidated the retail price maintenance provisions of the ABC Act dealing with distilled spirits and beer. A subsequent decision handed down by the First District Court of Appeal overturned similar provisions in the Act concerning sales of wine to consumers. As a result, "Fair Trade" provisions with respect to sales of alcoholic beverages by retailers are no longer a part of state law.
